Privacy Policy
Clear information about the personal data BrainyShack uses when you browse the website, contact us, download a free resource or purchase a digital product.
BrainyShack is operated by Shackhub Initiatives Ltd. We use personal information to provide our products, communicate with customers and operate our website. We do not sell personal information.
1. Who we are
Shackhub Initiatives Ltd, trading as BrainyShack ("BrainyShack", "we", "us" or "our"), is the data controller for personal information we use to operate our own website, deliver digital products and respond to customers. Independent services such as payment processors and external marketplaces may act as separate controllers for their own activities.
This policy applies to the BrainyShack website, System Finder where operated by us, feedback and enquiry routes, free resources and direct sales of BrainyShack digital products.
For privacy questions or requests, email hello@brainyshack.com.
Shackhub Initiatives Ltd is registered in Northern Ireland (company number NI732850). Registered office: 69 Blackrock Square, Newtownabbey, Northern Ireland, BT36 4NS.
2. Information we collect
The information we handle depends on how you interact with BrainyShack. It may include:
- Order and delivery details: your name, email address, billing details, purchased products, order identifiers and records of delivery or access.
- Enquiries and feedback: your contact details, message content and any files or screenshots you choose to send.
- Marketing preferences: your email address and records of subscriptions, preferences or consent when you opt in to updates.
- Website and device information: IP address, browser/device data, technical logs and cookie or analytics information where applicable.
Card payments are handled by the relevant checkout or payment provider. BrainyShack does not need to hold your full card number to fulfil an order.
BrainyShack systems are built for Notion. Information you enter into your own duplicated Notion workspace is held in your Notion environment; purchasing a BrainyShack product does not, by itself, give us access to your workspace records.
3. Why we use information and our legal bases
Under UK data protection law, we use personal information only where there is an appropriate lawful basis. These purposes and bases generally include:
- Performing a contract: processing purchases, supplying access information and responding to product or order support requests.
- Legal obligations: keeping transaction records and meeting applicable tax, accounting or legal requirements.
- Legitimate interests: protecting the website, detecting misuse, answering general enquiries and improving our products and customer experience where those interests are not overridden by your rights.
- Consent: sending optional marketing where consent is required, and using non-essential analytics or marketing cookies when legally required consent has been obtained.
We do not treat purchase confirmation or essential order-support messages as optional marketing. You can unsubscribe from optional marketing at any time.
4. Cookies and analytics
We use cookies and similar technologies for website operations, security and digital-commerce functions. Depending on the site or service, analytics, advertising or measurement tools may also be used.
Where a cookie or similar technology is not covered by a legal exemption, it must not be stored or accessed until the legally required consent is obtained. Where a technology qualifies for an applicable exemption, we must still provide the transparency required by law. Cookie categories, providers and choices should reflect what is actually enabled on the site you visit.
You can manage or delete cookies through your browser, although doing so may affect essential website functions. If a site offers a cookie preferences control, you can use it to update your choices. Contact us if you need information about the cookies used by a BrainyShack service.
5. Who may receive information
We share information only where needed to operate BrainyShack, fulfil orders, respond to enquiries or comply with law. Depending on the interaction, recipients may include website and commerce hosting providers such as Wix, payment processors, email or form providers, analytics providers where enabled and professional advisers acting on our instructions.
A product link may take you to a third-party service, including Notion or an external marketplace. Those services may process information under their own privacy policies. We do not sell or rent your personal information to advertisers.
We may disclose information where legally required or to establish, exercise or defend legal claims.
6. International processing
Some service providers may process or store data outside the United Kingdom. Where UK data-protection rules require safeguards for an international transfer, we use or rely on an appropriate legal transfer mechanism. You can contact us for information about the safeguards relevant to your information.
7. How long information is kept
We retain information only for as long as reasonably needed for the purpose for which it was collected, including product delivery, customer support, legitimate business administration, dispute resolution and legal or accounting obligations.
Transaction records may be held for statutory recordkeeping periods. Marketing details are retained until you unsubscribe or withdraw consent, subject to maintaining an appropriate suppression record. Enquiry or feedback records are reviewed against their continuing business need. We remove or anonymise information when it is no longer required.
8. Your data protection rights
Depending on the circumstances, you have rights to access, correct or erase personal information; restrict processing; receive certain information in a portable format; and withdraw consent without affecting processing already lawfully carried out. We normally respond to data-rights requests within one calendar month, subject to legal extensions where applicable.
Your right to object: You can object to processing based on legitimate interests, subject to the applicable legal rules. You have an absolute right to object to processing of your personal data for direct marketing. We will respect that objection.
To exercise your rights, email hello@brainyshack.com. We may need reasonable information to verify your identity. We will not require unnecessary personal information.
How to make a data protection complaint
If you believe BrainyShack has handled your personal information incorrectly, email hello@brainyshack.com with the subject line "Data protection complaint". Explain your concern and, if relevant, include your order or enquiry reference. Do not send passwords or complete payment-card details.
We will acknowledge receipt within 30 days, investigate appropriately without undue delay, keep you informed where necessary and explain the outcome and any steps we take. You can complain to the Information Commissioner's Office (ICO) independently, whether or not you have contacted us first.
9. Security and external services
We use reasonable technical and organisational measures intended to protect information against unauthorised access, loss or misuse. No online system can guarantee complete security.
Our site may link to Notion, social platforms or other independent services. Those services have their own terms and privacy notices, which should be read separately.
10. Changes and contact
We review this notice when our products, service providers, legal requirements or actual data uses change. We will update the date displayed on this page and communicate material new uses of personal data before beginning the processing where required.
