Terms of Use
The terms governing use of the BrainyShack website, its Notion-native digital products, free resources and direct purchases.
BrainyShack supplies practical, ready-built productivity systems for use inside Notion. These are digital products, not a separate BrainyShack software subscription.
1. About these terms
These Terms of Use apply to the website operated by Shackhub Initiatives Ltd, trading as BrainyShack ("we", "us", "our"). They cover access to our website and the direct supply of BrainyShack digital products and resources.
When you purchase a product, the description, price and any specific licence or delivery information displayed at checkout form part of your agreement. If a specific product term differs from this general policy, we will identify the difference before purchase.
We ask website users to be at least 16. If you are under 18, you should obtain any consent or assistance needed to enter into a purchase legally.
2. What our products are
BrainyShack sells focused Notion systems, connected Stacks and BrainyStack Pro OS, alongside selected free digital resources. Each product contains the operating areas and functionality expressly described on its product page; one product does not automatically include the features of another.
Where indicated, our systems are designed for Notion Free. You need a compatible Notion account, internet access and suitable equipment to use them. BrainyShack is independent of Notion and does not provide Notion's platform or control changes made to it.
Our products provide working structures for users to manage their own work. They are not accounting services, enterprise software replacements, a promise of business results or a service that runs your business on your behalf.
3. Orders, payment and delivery
The product description, total price (including applicable taxes), payment methods and any delivery conditions are shown before checkout. BrainyShack products are generally one-time digital purchases unless an individual product listing expressly states otherwise.
Successful direct purchases are supplied electronically, normally through an order confirmation and access instructions on the thank-you page and/or by email. No physical package is shipped. If digital content is to be supplied during an applicable cancellation period, the required express consent and acknowledgement must be obtained before supply begins.
We provide order information and contractual confirmation in a form you can save, such as email, including any consent and acknowledgement required for immediate digital content. Please contact us if your access information does not arrive or you cannot duplicate the purchased system.
The current product listing and order confirmation identify what was purchased. Product delivery does not give BrainyShack access to the data in your own Notion workspace.
4. Licence and permitted use
When you acquire a BrainyShack digital product, you receive a limited, non-exclusive licence to use it for your own personal work or internal business operations, subject to any specific licence terms communicated with that product.
You may adapt your duplicated Notion workspace for your own work. Unless a separate licence expressly allows it, you must not sell, redistribute, sublicense, publicly republish or supply the original system, its databases or a substantially equivalent template as a standalone product to others.
Free products are also provided for permitted personal or internal business use; free access does not transfer ownership of the product. Nothing in this section prevents conduct permitted by applicable law or reduces your statutory rights.
5. Your account and use of the website
Provide accurate purchase and support information and keep your account and access details secure. Do not use our website or products for unlawful activity, to interfere with website security, or to infringe the rights of others.
You are responsible for the business data you enter into your own Notion account, the people with whom you share that workspace, and the decisions made using it. We recommend maintaining appropriate backups or exports of important records.
6. Third-party services
Notion, payment platforms and any independent marketplaces operate under their own terms and privacy policies. Their availability, compatibility or rules can change independently of BrainyShack.
Products acquired from a third-party marketplace may also be subject to that marketplace's checkout, licence or refund terms, insofar as these are consistent with applicable consumer rights.
7. Product support and updates
We aim to provide accurate descriptions and reasonable assistance with access or a product fault. Contact us through the support email if something is not working as described.
Because purchased systems are duplicated into customers' Notion accounts, changes to our source products are not automatically pushed into an existing workspace. Any product-specific promise about future updates or upgrade guidance will be explained in the relevant listing or purchase materials.
8. Cancellation, refunds and consumer rights
When you buy digital content as a consumer, the normal distance-selling change-of-mind cancellation period is 14 days from conclusion of the contract, subject to the statutory exceptions.
For digital content not supplied on a physical medium, that right is lost after supply begins during the cancellation period only where the customer has expressly consented to early supply, acknowledged that the right will be lost, and received the required contractual confirmation of that consent and acknowledgement. Access to a download on its own does not establish those conditions.
If a statutory cancellation right remains available, you can exercise it by a clear statement sent to hello@brainyshack.com. An optional cancellation-notice example and details of refunds and remedies appear in our Refund Policy.
Digital content that is faulty, not as described or otherwise fails to meet statutory standards may entitle consumers to repair, replacement, a price reduction or refund as provided by law. These rights are not removed by immediate delivery, any product licence or this policy. Purchases made for business purposes may be subject to different legal rules.
9. Intellectual property
BrainyShack branding, original designs, copy, graphics, product structures and other original site or product materials are owned by Shackhub Initiatives Ltd or used under licence. Third-party marks and platform interfaces remain the property of their respective owners.
The licence to use a product does not transfer copyright or grant a right to redistribute BrainyShack's original work.
10. Availability, information and liability
We aim to keep our website usable and our product descriptions accurate, but temporary interruptions and changes to independent services may occur. Any demonstrations, examples or educational material are illustrative and are not a guarantee of productivity, earnings, financial performance or other outcomes.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or rights and remedies consumers have under applicable law.
Subject to those protections, we are not responsible for losses caused by matters outside our reasonable control or for business decisions made independently using information recorded in a customer-managed workspace. Any other limitation will operate only to the extent permitted by law.
11. Changes and governing law
We may update these website terms from time to time. Material changes do not retrospectively remove contractual rights arising from an existing purchase.
These terms are governed by the laws of Northern Ireland, subject to any mandatory consumer protections that apply where you live. Nothing in this provision restricts the right to bring a claim in a court where applicable law permits it.
